Legal, Licensure and Liability Risk Drivers for Senior Care
Recruitment and retention of staff and leaders, reimbursement, emergency and pandemic planning, comprehensive infection prevention and control programs, supply costs, staff competency and training, higher acuity resident care needs, consumer expectations, and increasing regulatory requirements are just a few of the daily pressures facing senior care leaders. The challenges over the past two plus years have strained the senior care industry fueling regulatory fines, sanctions, cited deficiencies and professional liability claims. The defensibility of staffing challenges is a real and ongoing risk. Specialized areas of service focus (e.g., memory care, behavioral health/mental health care, higher-acuity short-term rehabilitation, complex wound care, tracheostomy, and ventilator care) are also creating additional business risk exposure.
